(Your statutory customer rights are not affected.)
Seller means FADS.CO.UK (the trading name for Davrom Holdings Ltd,) and the company's web site www.fads.co.uk. Customer means the person or company to whom this document is addressed.
International Customer shall mean, Customer from outside the United Kingdom.

General - These terms and conditions are applicable to the supply of products made by the Seller, hereafter referred as FADS.CO.UK, to the buyer hereafter referred as the Customer.
Price - All prices are quoted in British Sterling and are inclusive of VAT (IF APPLICABLE) (as may be prescribed by law from time to time), unless otherwise specified.
3. Payment
3.1 Payment is taken upon dispatch (from supplier) of the order.
3.2 From time to time, FADS.CO.UK may request credit card information due to the lead time of the order. Note duplicate payment will not occur.
3.3 Payments must be made in British Sterling only, unless otherwise specified, and by one of the following payment methods (except International Customers see clause 14).
3.4 Major credit cards as listed: Visa, MasterCard, American Express, Delta, Maestro, Switch, Solo and Visa Electron.
3.5 From time to time FADS.CO.UK may request evidence of a driving license or utility bill to confirm they are the registered person of their invoice or delivery address.
4. Passing of Property
4.1 FADS.CO.UK shall retain the property of the goods until full payment has been made by the customer and has been received.
5. Passing of Risk
5.1 The risk in the goods shall pass to the Customer on delivery, as defined in clause 8 below.
6. Delivery
6.1 Deliveries are FREE of charge to Mainland England, Scotland (Excluding Scottish Highlands) and Wales. Additional
delivery charges will occur for Scottish Highland (clause 6.2). FADS.CO.UK cannot deliver outside mainland UK.
6.2 Deliveries to the Scottish Highlands and remote mainland UK (KW - IV - AB - PH - DD - PA - NR - SA - CT - TR - PL - TQ - EX - DT - LD) will take additional time and incur an additional delivery charge of £25. Delivery charges may apply depending on weight and the type of product being delivered. Please contact our Sales Department for more information.
6.3 FADS.CO.UK source products from different suppliers. If the Customer wishes to purchase more than 1 product, the Customer has the option to choose delivery of the good(s) together or separately. Alternatively we will try our best to ensure delivery is together. Any date or period for delivery shall be considered as indicative only; all delivery lead times are stated within the product listing.
6.4 Depending on the product(s) ordered, FADS.CO.UK will use a 1 or 2 person delivery team.
6.5 It is the responsibility of the Customer to ensure there is room for a 2 person team to unload and deliver the good(s). Depending on the location and type of delivery address access to lifts, ramps maybe required.
6.6 FADS.CO.UK will deliver the Customer’s good(s) via a 3rd party courier employed on behalf of FADS.CO.UK
6.7 Our 3rd party courier will contact the Customer prior to delivery. The Customer shall confirm with the courier a convenient date and time for delivery. The Customer’s chosen delivery date and time is an all day delivery. For estimated times and delivery cost please contact our Sales Department. Note the Customer’s selected delivery date and time maybe subject to change due extreme weather conditions or excessive traffic. Any missed delivery dates or cancelled delivery due to the Customer will incur a minimum £65 penalty. Additional charges may apply depending on the customers delivery address, type of product and delivery service.
6.8 Someone must be present and available to sign for the good(s) at the selected delivery address.
6.9 If the Customer has taken advantage of our Silver service or our Assembly service, the Driver will give the Customer time to inspect the good(s) before confirming the Customer to sign that they accept their good(s).
6.10 The Customer must sign for the goods upon delivery with our 3rd party courier’s paperwork and FADS.CO.UK consignment form. We advise all our customers to inspect the good(s) prior to signing for the good(s).
6.11 If the good(s) are faulty upon delivery, the Customer must inform the Driver and reject the good(s) and contact our Customer Service team on 0845 180 0894 whilst the driver is present. The Driver will then remove the good(s). The Customer must not sign for the good(s). FADS.CO.UK cannot accept any claim for damage where the product is not unwrapped and inspected and time of delivery.
6.12 Once the Customer has signed for the good(s) they have now accepted the good(s) and now solely responsible for the good(s). FADS.CO.UK shall not be held responsible for consequential loss, costs, damages, charges or expenses caused directly or indirectly in the delivery and acceptance of the good(s).
6.13 In the unlikely event that you need to return the item, FADS.CO.UK can only accept good(s) in its original packaging and condition. Semi, Unpacked or Assembled furniture cannot be returned. Note all returns are at the cost of the Customer. Cost may vary depending on collection address, delivery service, type of good(s) and the amount of good(s). Please follow our Returns Procedure for returning good(s).
7. Shipping
7.1 FADS.CO.UK will deliver the Customer’s good(s) via a 3rd party courier employed on behalf of FADS.CO.UK.
7.2 Our 3rd party courier will contact the Customer prior to delivery. The Customer shall confirm with the courier a convenient date and time for delivery. The Customer’s chosen delivery date and time is an all day delivery. Note the Customer’s selected delivery date and time maybe subject to change due extreme weather conditions or excessive traffic. 7.3 Any missed delivery dates due to the Customer will incur a minimum £65 penalty. Additional charges may apply depending on the customer delivery address, type of delivery service and product.
8. Passing of Risk
8.1 The risk in the goods shall pass to the Customer on delivery, as defined below.
8.2 In the event of an order being lost by a third party, FADS.CO.UK bears no risk once it has left their trading premises or suppliers trading premises or any 3rd party couriers trading premises.
8.3 Where goods have been received damaged, please follow clause 6.11, 6.12 and 6.13
8.4 Depending on the good(s) or issue, it may take a minimum of 7 working days for FADS.CO.UK to resolve an issue/ refund or exchange. Please follow clause 6.12 and 6.13
8.5 In the event of either of the above, FADS.CO.UK will forward a claim to our 3rd party courier and supplier. Before this can be processed, FADS.CO.UK will issue the customer with a `Product Issue Form`' which must be completed and returned before any claim can be pursued.
9. Acceptance
9.1 Any item apart from what is mentioned in the title, that appear(s) in any photograph, representation, or illustration on this site or in our brochures will not form a part or be included in this contract. It is meant for illustration purposes only, and may not be included as a part of the good(s). Depending on the Customer(s) monitor or screen resolution, FADS.CO.UK bears no risk on difference of colour.
9.2 Any advertisements or specifications issued by the company and any descriptions or illustrations provided on our website or brochures will not be included in this contract. It is provided for guidance or illustration purposes only, and may not have any relationship with the goods.
9.3 Any typographical, clerical, or other error present on the Company's website, in the confirmation on our invoice sent to you, in our price list, or in any brochures or documentation issued by us shall be subject to correction without any liability on the part of the Company.
9.4 The Customer shall inspect the good(s) upon delivery, as stated in Clause 6.
9.5 FADS.CO.UK shall not be responsible for consequential loss, costs, damages, charges or expenses caused directly or indirectly in the delivery and acceptance of the good(s).
9.6 The Customer shall be deemed to have accepted the goods unless within 7 days after their receipt the Customer shall have notified the seller that the goods are rejected. (This does not however affect the customer's statutory rights). If no such action has been taken, FADS.CO.UK shall consider the products being as described, of satisfactory quality and fit for their purposes, and may not accept any reject at a later date.
10. Returns Procedure
10.1 If the goods are to be rejected in the time limit set in clause 9 above, the Customer shall comply with the return procedure as defined in clause 10 below.
10.2 FADS.CO.UK will not accept any returned good(s) should the return not follow the aforementioned return procedure.
10.3 The Customer is required to email FADS.CO.UK returns department – returns@fads.co.uk to notify their intention to return any goods. Please note depending on the good(s) or issue; it may take a minimum of 7 working days for FADS.CO.UK to resolve an issue, refund or exchange.
10.4 The Customer will also have to complete a `Product Issue Form`.
10.5 FADS.CO.UK may request photographic evidence or other forms of evidence. The Customer must comply with FADS.CO.UK in order to process their intention to return their good(s). Any delay in providing information to FADS.CO.UK Returns Department will delay a Customer(s) issue.
10.6 In cases where the rejection of the goods is due to a defect or discrepancy in the order, the Customer is entitled to a full refund or replacement. The faulty or damaged product must be returned to FADS.CO.UK supplier before the refund or replacement can be issued. The Customer must follow clause 10.3 and 10.4 above in order to comply with the returns procedure.
10.7 In cases where the rejection is due to an incorrect order from the Customer or to dissatisfaction, the Customer is entitled to a partial refund (full refund less postage, where standard delivery will be charged at £95. Cost may vary depending on the delivery service, item and goods collection address) only. Goods must be returned to FADS.CO.UK supplier before the partial refund can be issued.
10.8 Note Semi, Unpacked or Assembled items cannot be returned. Returned item(s) must be in its original packaging and condition and in a saleable condition.
11. Cancellations
11.1 Cancellations are only accepted if the Customer complies with the following cancellation procedure. If the order has been despatched or FADS.CO.UK has a binding contract with our supplier prior to the cancellation, the return procedure in clause 10 above will apply. If the procedure is not respected, the order will be considered valid and the Customer will remain liable for full payment.
11.2 Cancellations must be made with FADS.CO.UK Customer Services department customerservices@fads.co.uk
11.3 We will issue a full refund if you change your mind for any reason within 7 days of placing your order. After this date, a binding contract with our suppliers to supply your product will have been issued.
11.4 If cancellations are made after the 7 day period, a 50% cancellation fee of the order value will occur.
11.5 If the good(s) have already been despatched, FADS.CO.UK cannot refund any monies spent on delivery (clause 10.7).
11.6 FADS.CO.UK reserves the right to cancel an order if: We do not have stock to fulfill the order, If we are unable to deliver the product to your area, If your payment was not authorized, If an item was incorrectly priced or described on the website.
12. Privacy Policy
Any information passed through to FADS.CO.UK is managed in accordance with the Data Protection Act 1998 (registration number PZ2133226) and is passed through a secure connection on the internet using Secure Socket Layer technology at 128bit encryption (where browsers will allow). If a customer wishes for their information to be removed from our database, this should be requested in writing to customerservices@fads.co.uk
Please note, credit card details are not retained online. The only information stored is a customer's transaction history, name, address & e-mail address. These may be used for marketing purposes by FADS.CO.UK or any associated companies. Customers will not be sent 'spam' e-mail. Should any customer not want their details used for marketing purposes, please email a request to be removed customerservices@fads.co.uk
13. License Agreement
The Customer shall respect all license agreements delivered by the copyright owners FADS.CO.UK cannot be held responsible or liable for any misuses conducted by the Customer or any third party. All trademarks shown on WWW.FADS.CO.UK belong to their registered owners and must not be copied without prior permission.
14. International Customers
Customers from outside the UK can only pay by International credit card and must pay in Pound Sterling unless otherwise specified. FADS.CO.UK can only to deliver to mainland UK. All other terms and conditions apply.
15. Law
These terms and conditions are governed and shall be interpreted in accordance with English Law. Any person attempting to make fraudulent credit card transactions will be prosecuted with no exception.
